R&C Attorney G. Allen Featured on MD Bar Association's Real Property Blog
R&C Attorney Gwendolyn Allen, the editor of the Maryland Bar Association's Property Blog entitled "Ground Rules", authored a blog post of her own this past week in which she discussed the recently concluded litigation surrounding the redevelopment of White Flint Mall in Bethesda, MD. The post discusses the case of Lord & Taylor, LLC v. White Flint L.P which recently came before the United States Court of Appeals for the Fourth Circuit. The dispute arose because of pending redevelopment plans which aim to turn White Flint mall into a walkable mixed use development. Lord and Taylor claimed that a provision in its original restrictive covenant with the mall owners, from 1977, prevented the mall owners from undertaking this redevelopment. However, the Fourth Circuit held that the restrictive covenant, restoring the mall to a traditional first class shopping center, was an infeasible undertaking given that the mall has been almost entirely vacant since December 2013.
